Tenant 'vindicated' for withholding rent

"Good night, sleep tight and don't let the bed bugs bite" has become more than a childhood rhyme for Frank Manion. It's his dream.

The 67-year-old Mount Clemens resident's apartment has become infested with bed bugs that spawned a dispute with his landlord.

Manion withheld his $560 per month rent for December due to the bed bugs, prompting landlord Leonard Charla to file for evicting Manion from the six-unit building on Third Street at Dickinson Avenue.

Manion on Thursday won an order from Judge Carrie Fuca of 41B District Court in Clinton Township that compels Charla to exterminate the bed bugs before he can collect Manion's rent. Manion will put the money into an escrow account.

"My client was vindicated," said James Galen, Manion's attorney. "This retaliatory attempted eviction was stifled because we brought in evidence. We brought in actual live bed bugs. The bed bugs were evicted from the court but my client wasn't evicted from his home. It was a good day."
